Today, the 31st of January, in the hallowed year, election year 2006, could be a memorable day if we all do our part, which is simply to concentrate, among other things, and do perhaps what a couple of groups have decided would be useful for the President, I guess his State of the Union. We might give him some idea of our state, which is one of great dissatisfaction with him and his regime. And there's talk of perhaps demonstrating in front of the Capitol or here or there around the country to show that the union is occupied by people who happen to be patriots. And patriots do not like this government.
This is an unpatriotic government. This is a government that deals openly in illegalities, whether it is attacking a country which has done us no harm, two countries -- Iraq and Afghanistan -- because we now believe, not in declaring war through Congress as the Constitution requires, but through the President. "Well, I think there are some terrorists over there, and I think we got to bomb them, huh? We'll bomb them." Now, we’ve had idiots as presidents before. He's not unique. But he's certainly the most active idiot that we have ever had. |

Dean went on to say, "Republicans would like us to believe that Democrats are involved ... they're scared and they should be."

… BLITZER: Should Democrats who took money from Jack Abramoff, who has now pleaded guilty to bribery charges, among other charges, a Republican lobbyist in Washington, should the Democrat who took money from him give that money to charity or give it back?
[DNC Chairman Howard] DEAN: There are no Democrats who took money from Jack Abramoff, not one, not one single Democrat. Every person named in this scandal is a Republican. Every person under investigation is a Republican. Every person indicted is a Republican. This is a Republican finance scandal. There is no evidence that Jack Abramoff ever gave any Democrat any money. And we've looked through all of those FEC reports to make sure that's true.
BLITZER: But through various Abramoff-related organizations and outfits, a bunch of Democrats did take money that presumably originated with Jack Abramoff.
DEAN: That's not true either. There's no evidence for that either. There is no evidence...
BLITZER: What about Senator Byron Dorgan?
DEAN: Senator Byron Dorgan and some others took money from Indian tribes. They're not agents of Jack Abramoff. There's no evidence that I've seen that Jack Abramoff directed any contributions to Democrats. I know the Republican National Committee would like to get the Democrats involved in this. They're scared. They should be scared. They haven't told the truth. They have misled the American people. And now it appears they're stealing from Indian tribes. The Democrats are not involved in this.
BLITZER: Unfortunately Mr. Chairman, we got to leave it right there.

Samuel Alito's view of presidential powers will be a central issue in today's Supreme Court confirmation hearings in front of the Senate Judiciary Committee. Alito's position is consistent with Vice President Dick Cheney's statement, "The president of the United States needs to have his constitutional powers unimpaired, if you will, in terms of the conduct of national security policy." According to the Boston Globe, "At this moment in American history, it would be hard to find a worse Supreme Court nominee than Samuel A. Alito Jr. His ideology captures everything extremist about the Bush administration. If confirmed, Alito would serve as Bush's enabler." In this week's hearings, Alito will need to prove his independence from the White House and his distance from his past work pushing an all-powerful executive. Shortly after it was revealed that the Bush Administration had been using the National Security Agency to spy on American citizens without oversight by any court, Governor Dean sent an email asking you to join him in signing a Freedom of Information Act request demanding that the White House release Justice Department memos outlining the supposed authority for this illegal program.
The response to this request was overwhelming, and new signers came in daily for the past two weeks.
We spent the past few days printing all 160,000 requests, boxed them up, and DNC General Counsel Joe Sandler, blogger Tim Tagaris and I drove downtown to the Department of Justice and formally submitted them. Joe did the talking and I took the pictures -- you can see them here:

The Justice Department has to respond within 20 days. But we may hear from them sooner -- a judge on the secret Foreign Intelligence Surveillance Court, which exists to provide a crucial check on executive power while allowing maximum flexibility to our intelligence services, has demanded the administration explain the supposed legal authority for this domestic spying program. The hearing will take place on Monday.
Your 160,000 requests demand exactly the same information. This gets to the core of the domestic spying scandal: we need to know what authority this administration thinks it has to conduct a program like this not only to get to the bottom of this illegal activity, but to understand just what this administration thinks it can and cannot do. Reports suggest that the vague assertion of authority to spy on Americans may be part of a larger claim of blanket authority to conduct all kinds of blatantly illegal activity - from improper detentions to torture.
George Bush himself said on the campaign trail in 2004 that any wiretap "requires a court order". But he recently admitted that years before that statement, he had personally directed our intelligence agencies to conduct surveillance on Americans without going to any court for a warrant - even though secret warrants could be obtained up to 3 days after the surveillance had begun.
It's clear that our Constitution and the rule of law mean very little to this president -- and we've seen this kind of secrecy and abuse of power before. The DNC Communications team put together a short video that looks at George Bush's Nixon-like justification for the actions he ordered:

Back in 1755, Benjamin Franklin said, "Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety."
This administration, whose strategy for fighting terror involves unnecessary illegal wiretaps on Americans, seems to have given us exactly what Franklin predicted. Democrats will protect our nations liberty and security.
